All 12 suspected credit card scammers charged with estafa after they were caught in Dumaguete City allegedly using fake credit cards and similar access devices have posted bail for their temporary liberty.

Four of them posted bail Friday, Nov. 3, at the Regional Trial Court (RTC) Branch 38, while the eight others had done the same a week ago or last Oct. 27, 2017.

The four who posted bail today were Mark Joseph Nombre, Michael Mijares, Ramon Viscarra and Alpa Christian Villanueva.

Of the four, Nombre, Mijares and Viscarra posted bail at P32,000 while Villanueva, who were among those who gave their true identities during a previous hearing, was granted bail at P16,000.00.

The eight who posted bail last week were Ronnel Sotolombo, tagged as the alleged leader of the group (and whose live-in partner, Miggy Noble, was killed in Dumaguete) , Ralph Levin Lizardo, Niño Peñada, Roberto Consul, Jr., (the live-in partner of Bien who was also killed in Dumaguete), Duchaun Herbert Mendoza, Ray Lester C. Lizardo, Jonathan Adajar and Bernardo Saragina.

Bailbond for the five out of the eight were doubled from P16,000 to P32,000, while the three Ray Lester Lizardo, Adajar and Saragina remained at P16,000, according to Atty. Freddie Hermosa who represented Roberto Consul, Jr.

Hermosa said he was told the bailbond was doubled because they lied twice to the court about their true identities.

If a person lies the third time about his or her identity, the bailbond will be tripled.

Since their arrest on September12, several hearings were conducted for the court to determine their real identities that requires in-depth investigation and verification in Pasay.

National Bureau of Investigation (NBI) agent Paul Dosdos was sent on a mission to Pasay City n Metro Manila for several days and he practically visited all the homes of the accused, complete with photographs and affidavits of two disinterested persons and even photographs during baptismal and graduation of one of the suspects, which were presented in court.

One of the 12 is an incumbent barangay secretary of Barangay 77, Zone 10, District 1, Pasay City, identified as Ray Lester Lizardo, while Roberto Consul, Jr. is a son of a barangay kagawad in Barangay 54, Zone 8, Pasay City. Photographs showed that the NBI agent was with the village chief William Lim inside the barangay hall.

The NBI agent also went to Barangay 140, Zone 15 in Pasay to confirm the identity of another suspect and in Sto. Cristo, San Pablo City.

The investigation report of the NBI was made as basis for the granting of the bail to the 12 accused, according to Atty. Hermosa.

Meanwhile, the city prosecutor’s office is also expected to issue a resolution in the next few days regarding the other cases filed against the 12.

Preliminary hearings were conducted last week on the complaints for estafa, alleged violation of the RA 8484 otherwise known as an act regulating the issuance and use of access devices and prohibiting the fraudulent acts committed relative thereto, as well as the Cybercrime Prevention Act of 2012.

Hermosa has confirmed that complainants include Casa Rubin, Max’s Fried Chicken and BDO here.

As to claims that the 12 will jump bail, Hermosa said he relied on the suspects’ statement that they will appear during the scheduled hearings because their identities had been verified and that their postal addresses had been ascertained.
