CSC voids transfer of pharmacist

The Civil Service Commission has invalidated the transfer of a pharmacist from the Negros Oriental Provincial Hospital to the Canlaon District hospital and ordered the payment of her withheld salary for five months.

In a Decision dated July 17, Civil Service Commission Chairperson Alicia dela Rosa-Bala granted the appeal of Ma. Enrelita Lagahit, pharmacist III of the Provincial Hospital of Negros Oriental.

Lagahit had contested the Memorandum of Gov. Roel Degamo dated August 1, 2016 transferring her to Canlaon for a period of six months supposedly to “improve the operational efficiency and management of the pharmacy system”.

She claimed that the reassignment violated her Constitutional right to Security of Tenure and that it amounted to demotion in her rank, status and salary.

Lagahit also questioned another Memorandum from the Governor dated Nov. 7, 2016, assigning her as pharmacist of the PHO technical Services and relieving her as a member of the NOPH therapeutics Committee.

She said the Memorandum is equivalent to a demotion in her rank, status and salary and that violates Section 6 (c) of the Magna Carta of Public health Workers.

The Civil Service Commission submitted the case for resolution after repeated orders to Degamo to comment on the appeals went unanswered.

The Civil Service Commission agreed with Lagahit’s appeal. It noted that she would have to entail additional expenses due to her reassignment, and does not mention the provision of any relocation allowance or staff housing. (AP)
