City Prosecutor Eliezer Escorial has dismissed the robbery case filed by Dr. Peter Dayot, OIC of the Office of the President of the Negros Oriental State University, against then President Don Vicente Real and five other school officials.
In a Resolution dated March 19, 2015, Escorial approved the recommendation of Associate City Prosecutor Andre Stephen Jacobo to dismiss the complaint.
The case stemmed from the recovery of three boxes from Dr. Real as he was leaving the campus gate in January after a standoff over the legitimacy of his presidency.
Also cleared of the charge were Jose Rene Cepe, Marx Iturralde, Frederick Zerna, Robert David, and Raymond Librando.
The Prosecutor noted that neither the complaint nor any of the supporting affidavits made any specific allegation as to the nature and value of the allegedly stolen property.
Neither was there any proof that the complainant Dr. Dayot was the owner of the recovered boxes.
