Five entertainment and resto bars in the municipality of Sibulan were padlocked today on orders of Mayor Jose Pepe Abiera for long years of operating without the required mayors and business permits.

The five resto bars were successfully padlocked today without vehement objection except for one who owns two of the five establishments.

These establishments are the Midnight Blue owned by Jelly Sumagang, Sweet Angels owned by Jenivie Alejandro, Virgo KTV and dancing hall and Exotic Entertainment bar owned by Pretzel Torralba as well as Happy Hour, the former Fantasy owned by Yelyn Chavarria.

They were padlocked for violating provisions of Ordinance No. 52, series of 2017, otherwise known as an ordinance prescribing guidelines for the establishment, operation and maintenance of entertainment bars, karaoke, videoke bars, night/day clubs and other establishments of similar nature, incorporating provisions on health and other safety measures and personnel, further providing penalties for violation thereof.

Municipal administrator Roy Calingacion stressed the closure order will only be lifted as soon as the establishments are able to comply with all the requirements including compliance of the provisions of Ordinance No. 52, that prohibits lewd shows and other immoral acts not conforming to the patterns of conduct usually accepted, shows that is characterized by or inciting to lust or lechery and lasciviousness, shows that are offensive to morality or decency, pornographic or sexually explicit videos, photographs, writings or the like whose purpose is to elicit sexual arousal.

The team did not dwell yet on these provisions, but on the physical aspect, building permits, occupancy certificates, among others.

Midnight Blue in Boloc-boloc, Sibulan was compliant in everything except that it has no certificate of occupancy because of the distance provision from the Negros Maritime College which is 64.4 meters way beyond the 150 meter distant requirement.

Sweet Angels in Maslog has no building permit, along with Happy Hour in Agan-an, while Exotic Entertainment Bar in Tubtubon, Sibulan has no certificate of occupancy and has not even responded to calls from the municipal engineer’s office for the scheduled ocular inspection.

Municipal Engr. Christian Cuevas stressed that Exotic Entertainment Bar cannot be issued a certificate of occupancy because of the distance requirement having a distance of 87 meters from the Presbyterian Church in the area.

Inspite of name-droppings, and threats of filing charges, the team composed of the municipal administrator, the municipal engineer, the Sibulan Police, representatives from the fire department, padlocked the EXOTIC entertainment bar.

The secretay to the mayor Irish Requiron Puspos said Mayor Jose A. Abiera has given them enough and ample time to comply with provisions of the law, since their first meeting in March this year, followed by another meeting of all the operators in May 21 this year where they promised to comply with the requirements, except for one SAB Jackpot in Boloc-boloc, Sibulan who immediately complied one month after the second meeting.

Said these establishments are operating for the longest time without mayors permits, and so after the October 4, 2019 final closure notice, they were given 10 days within which to comply with the requirements, the last day of which was October 18, 2019.

The closure order was due to non compliance of the fire and building code, lack of parking spaces, without mayors and business permits, while alleged lewd shows, stage shows, pole dancing, among others have yet to be validated because this is the perfectly the essence of Municipal Ordinance No. 52.

Jackpot was issued a business and mayors permit because it removed the platform or stage inside, including the steel pole used in dancing and no more exclusive rooms for VIPs. Puspos stressed continuous monitoring is being conducted to ensure compliance of the provisions of Mun. Ord. 52.

When asked why the closure order was implemented during day time, the secretary to the mayor explained, it was the desire of Mayor Abiera not to embarrass their patrons and prevent uncomfortable situations for both management and patrons alike. Reports have it that these five resto and entertainment bars have “indecent” activities inside especially late in the evening. She said this concern will be addressed in another forum.
