Tricycle driver charged for assaulting enforcers

Contrary to what was earlier claimed, the Joint Inquest Resolution of the City Prosecutor Office signed by Associate Prosecutor Julito N. Lumusad and approved by City Prosecutor Joseph Arnel Zerna, found the tricycle driver Ronard Bello Faburada as the aggressor after defying the traffic enforcers who tried to apprehend him.

The suspect was armed with a 21-inch long steel pipe, which he used to assault Traffic Enforcer Reynaldo Jumawan Montebon twice.

But since Montebon was wearing a helmet, the blows were mitigated. TMO Head Gilbert Albong said that Faburada was subsequently arrested by the TMO officers and Police Officers Police Staff Sergeant Vicente M. Enoferio and Police Corporal Allan I. Sugone using reasonable force.

Faburada is charged with Direct Assault and Disobedience and Resistance per complaint of Traffic Enforcers Reynaldo Jumawan Montebon and Rowel Alabastro Abueva.

The incident started at 3:30PM, Friday, (October 4) when Faburada driving MCH No. 0775 was in the loading area of Lee Super Plaza and allegedly refused to convey a lady passenger who asked to be transported to Barangay Bantayan. Faburada instead picked another passenger. TMO Officer Abueva tried to intervene and asked for his driver’s license, but Faburada refused and speeded away.

Officer Abueva called the attention of Faburada when he returned to the bay area of Lee Super Plaza and invited the driver to TMO Office.

Abueva boarded Faburada’s MCH supposedly going to TMO Office but the driver picked another passenger going to Aly Mae in Pulantubig. This prompted Abueva to call the assistance of his fellow Traffic Enforcers who intercepted the MCH in Purok Kalubihan Barangay Daro.

Faburada was apprised of his violations: driving without a mayor’s permit, arrogance and refusal to convey a passenger. When Officer Montebon arrived, Faburada suddenly got a 21-inch long steel pipe and assaulted the officer causing him to sprawl on the ground. Not contented, Faburada also tried to hit the other officers but with the help of the responding policemen. Faburada was arrested and now detained in the custodial cell of the City Police Station.

The City Prosecutor’s Office found sufficient ground to hold the respondent Ronard Bello Faburada for trial for the crimes charged, it is recommended that the corresponding information for Disobedience of an agent of person in authority under Article 151 of the Revised Penal Code as amended, and Indirect Assaults under Article 149 of the same code to be filed in the proper court.

TMO maintains that the enforcers were just doing their jobs and defended themselves from the tricycle driver who was armed and trying to harm them. (PIO)
